ATTENTION: These terms and conditions apply to the entire contents of this website ("Site") and to any correspondence by email between HUSSSH and any User. Please read them carefully before using the Site. Use of the Site indicates that you accept these terms and conditions.
These terms and conditions ("User Terms") apply to all persons who access the Site ("User"). The Site is operated by Hush Scandinavia AB, Linjegatan 3D, 302 50 Halmstad, Sweden ("HUSSSH", "we" or "us"). Company information is set out in our Legal Notice. HUSSSH may change these User Terms from time to time; the version published on the Site at the time of use applies.
The Site is a trade portal for pharmacies, salons, distributors, white-label and licensing partners and other business customers. Its content is trade information for professional audiences; it is not consumer advertising, not an offer capable of acceptance, and not medical advice. Product availability, specifications, pricing and market eligibility are confirmed in writing in individual trade agreements, which take precedence over the Site. Each trade partner remains responsible for assessing the regulatory requirements of its own market.
3.1 All documents, information, images and other materials ("Information") on the Site are protected by copyright under the Swedish Copyright Act (Upphovsrättslagen, SFS 1960:729) and applicable EU and international law and, unless indicated otherwise, remain the property of HUSSSH. No portion of the Information may be reproduced in any form, or by any means, without prior written permission from HUSSSH.
3.2 Users may reproduce Information for the purposes of their own internal business evaluation, provided that no text or related graphics are modified in any way, no graphics are used separately from the corresponding text, and all text and graphics carry the HUSSSH copyright notice.
3.3 If a User breaches this section, their permission to use the Site terminates automatically and they must immediately destroy any downloaded or printed extracts from the Site.
The trademarks, logos and service marks ("Marks") displayed on the Site, including HUSSSH®, are registered or unregistered trademarks and may not be used without prior written consent.
The Information on the Site is provided for general trade information and "as is". HUSSSH makes no warranty or representation as to the completeness or suitability of the Information for any particular purpose. Warranties for products are governed exclusively by the relevant trade agreement.
Some Information on the Site may contain projections or other forward-looking statements, including market figures from third-party sources. These are estimates only, and actual events or results may differ materially.
Links to third-party websites are provided solely for convenience. HUSSSH does not control and is not responsible for these websites, their content or their availability.
To the extent permitted by law, HUSSSH and its officers, directors, shareholders and agents exclude any liability for loss or damage that may result to you or a third party in connection with the Site or its use, the inability to use it, or any websites linked to it. Nothing in these User Terms limits liability that cannot be limited under mandatory Swedish or EU law, including liability for wilful misconduct or gross negligence.
Personal data submitted through the Site is processed in accordance with the GDPR and our Privacy Policy.
These User Terms, and any dispute arising out of or in connection with them or the Site, are governed by Swedish law, without regard to its conflict-of-law rules. Disputes shall be settled by the Swedish general courts, with Halmstad District Court (Halmstads tingsrätt) as the court of first instance.
